Auction Sale – The Swan Tarporley, Wednesday 16 September at 7pm

Thomas Pearson, an associate and head of DTM’s commercial Property team is acting for the vendors on the sale of 4 lots at Auction on 16th September 2009.

Three of the lots are being sold by Strutt & Parker and Wright Manley at the Swan Hotel, Tarporley and consist of 79acres of fertile pasture and arable land (to be split into three separate lots; 18.35 acres, 30.69 acres and 30.26 acres) on the Peckforton Estate.

Sales particulars for all lots can be obtained from the agents and auction packs will be available to inspect at DTM’s offices, Archway House and at the agents during normal office hours in the 14 days prior to the auction.

Commercial Tenancies: Rent Arrears and Forfeiture

In the current economic climate, relationships between commercial landlords and their tenants are becoming ever more strained.

On the one hand, a commercial landlord will want to receive a steady income stream from their tenanted property, and will want to ensure that there is a tenant within the property to discharge the commercial rates at the very least.

On the other hand, whilst commercial landlords are often keen to ensure that the rent and rates are paid, in the current period of recession, many tenants simply cannot afford to pay full rent.

Many commercial landlords are now seeking to recover rent arrears from their tenants, or, in more serious cases, landlords are seeking to ‘forfeit’ (or end) tenancies early due to non payment of rent arrears.

If a landlord wishes to forfeit a lease, it is essential that the landlord does not inadvertently ‘waive’ their right to forfeit a lease. A landlord can waive the right to forfeit a lease by their actions, and waiver can occur as a result of something as simple as the landlord asking the tenant for rent.

Getting into the Rat Race


Tom Sutcliffe, an Associate from our corporate team, recently completed the Edinburgh Rat Race. Racing as a pair along with Nick Grantham of SmartFitness (see Nick’s blog for a more comprehensive commentary http://nickgrantham.blogspot.com ), they completed 2.5 hrs of running-based orienteering on the Saturday evening, followed by 8 hours of mountain bike orienteering on the Sunday. Each event consisted of planning a route around the city of Edinburgh (and its suburbs) with the objective of reaching as many checkpoints as possible within the allotted time. Sounds easy?, well each checkpoint came with a different physical or mental challenge ranging from cycling down the infamous Warrister Steps to completing a Dragons Den presentation with 2 minutes of preparation time!

Tom and Nick finally completed the 2-day marathon event at 5pm on Sunday, finishing 30th out of 120 teams. Not bad for a first attempt but both have resolved to return next year to challenge the top 10!

Mergers & Acquisitions in the Care Sector

Transactions in the care sector have their own idiosyncrasies which make them slightly different to mergers & acquisitions in other sectors making it essential that the parties involved in such transactions appoint solicitors with the relevant experience.
